What Florida Courts Consider When Determining Child Support
Florida courts consider a number of factors and have a great deal of leeway when determining alimony — more so than child support. The courts may not order spousal support at all. This is a complex issue that can spark heated disputes.
Florida law has identified several types of spousal support, ranging from “bridge the gap” payments that last two years or less to a lump sum payment or permanent alimony. The court considers a number of factors when determining the amount and the duration of spousal support, including:
- The length of the marriage
- The standard of living set during the marriage
- The age of each party, as well as their physical and emotional health
- The financial stability of each party and earning potential
- Each party’s assets and liabilities
- The contributions of each party to the marriage, including providing primary child care
